I accept that by becoming a member of the City Chic mailing list that I will receive periodic notification via email, text messaging and or conventional post outlining news, offers and other information relevant to their product services.

I understand that all personal information provided by myself on this website including joining as a member, competition entries, makeover entries or requests for expert advice will reside in a centralised database at City Chic head Office in Alexandria, Sydney, Australia. I also understand that this information will be updated as and when requested only by myself or as authorised by me. I understand it is my right to have access to any of my personal details held by City Chic and that this information will be provided to me within a reasonable amount of time.

Gift Card T&Cs

*All Gift Cards purchased up until the 30th March 2018 are valid for 12 months from date of issue. Any Gift Cards purchased from the 31st March 2018 onwards will be valid for 3 years from the date of issue.

A Gift Card is only valid for the currency/country in which it is issued. Refunds are not available on this item. $25 is the minimum value and $500 is the maximum Gift Card value a customer can purchase. A customer does not need to spend the full value of the card in one transaction. The remaining value is stored on the Gift Card. Any remaining balance on the Gift Card cannot be redeemed for cash or refund. A Gift Card cannot be topped up. City Chic Rewards points are not earned when a customer purchases a Gift Card. Promotions, Coupons/Vouchers, Afterpay payments, and Gift cards may not be used toward the purchase of a Gift Card.

Voucher T&Cs

These Voucher Terms set out the terms on which we issue discount or nominated value vouchers. They apply to physical vouchers and to voucher and discount codes we issue (Vouchers). By applying for or using a Voucher, you consent to these Voucher Terms and any other Voucher terms (Specific Voucher Terms) printed on the Voucher or listed on the website or email from us where the Voucher was offered.

1. Each Voucher type is identified by a voucher code and has different requirements and rewards including Specific Voucher Terms, in addition to these Voucher Terms. These Voucher Terms and all applicable Specific Voucher Terms must be met to be eligible for the Voucher and to receive the discount or offer covered by the Voucher. The Specific Voucher Terms override these Voucher Terms to the extent of any conflict. Examples of our current Vouchers include Reward Vouchers, Privilege Vouchers, Anniversary Vouchers, and Birthday Vouchers.

2. Voucher values or discount rates or amounts, as applicable, are as specified on the Voucher. The maximum value of a Reward Voucher issued per transaction is $50. All value amounts are specified in Australian dollars. Vouchers with a face value can be redeemed in Australian dollars only.

3. There is a limit of one Voucher per household per offer unless the Specific Voucher Terms expressly provide otherwise.

4. Vouchers are intended for single use only on a single order unless the Specific Voucher Terms expressly provide otherwise.

5. Where a physical Voucher is issued to you, only the original Voucher will be accepted for use. You may be required to collect the Voucher from one of our stores. You must surrender the Voucher when you use it unless the Specific Voucher Terms expressly allow for multiple uses. You must not reproduce or copy the Voucher and the Voucher is not valid if reproduced or copied unless the Specific Voucher Terms expressly provide otherwise, for example by allowing you to print the Voucher from the relevant website or insert a Voucher code.

6. Vouchers are applicable to valid direct debit and credit card purchases only. They cannot be used for lay-by purchases whether for a deposit or payment.

7. Vouchers are usable only on or at our web site or stores. Some Vouchers may be limited to one specific site or channel – for example, a Voucher may only be for use at a physical store or only for online use; please check the Specific Voucher Terms. Without limitation, Reward Vouchers printed from a physical stores’ point of sale system cannot be used for online purchases. Reward Vouchers can be used in the issuing store on the day of issue and in other stores on the next business day, subject to expiry terms. Privilege, Anniversary and Birthday Vouchers that we email to you can be used online unless the applicable Specific Voucher Terms state otherwise.

8. In the case of an order containing multiple items, the value of the Voucher is allocated to each item based on the proportion of the item's value to the total value of all items, excluding shipping, taxes and other charges.

9. Certain items may not be eligible for purchase using the Voucher. These will be notified in the Specific Voucher Terms. Generally, Vouchers cannot be used to purchase gift cards.

10. A Voucher cannot be used to pay for taxes, shipping, and handling or other charges unless the Specific Coupon Terms expressly provide otherwise. Any Voucher offering free shipping applies only to shipping of products within the area we designate from time to time.

11. Some Vouchers are subject to a minimum purchase requirement. Taxes, shipping and handling, and other charges do not apply towards meeting the minimum purchase amount.

12. A particular Voucher cannot be combined with any other offer or Voucher in the same order unless the Specific Voucher Terms expressly provide otherwise.

13. Each Voucher (excluding a single use Voucher, which expires on use) is valid for a limited time only and expires on the date specified in the Specific Voucher Terms unless used or terminated earlier in accordance with these Voucher Terms. Most Reward Vouchers expire 30 days after issue.

14. Vouchers are not for resale and are not redeemable for cash. If the order value is lower than the Voucher value, the remaining amount of the Voucher value is lost.

15. Physical Vouchers cannot be replaced if lost, stolen, mutilated, defaced, tampered with or deleted.

16. A Voucher cannot be applied to orders already placed.

17. If a Voucher is used and your entire order is canceled or rejected, or if you return all items in your order, we will refund the actual amount paid subject to our applicable trading terms but the Voucher will no longer be valid.

18. If a Voucher is used and only part of your order is canceled or rejected, or if you return only some of the items in your order, a partial Voucher discount will still be applied to the remaining item(s) that are processed.

19. We may discontinue, cancel or refuse to issue or honour a specific Voucher or Voucher type at any time for any reason without notice. This may occur for a range of reasons including due to errors associated with issuing or processing the Voucher or Voucher type or because we consider that you or the Voucher applicant have applied for or used the Voucher improperly or outside its intended purpose or operation or in breach of these Voucher Terms including any Specific Voucher Terms or because the Voucher has been tampered with or altered.

20. These Voucher Terms cover only the Voucher itself. Our specified trading terms also apply to your purchases of products or services using the Voucher.

CC Nation T&Cs

1. Introduction

1.1 The City Chic Nation Loyalty Program is conducted in accordance with these terms and conditions. By joining the City Chic Nation Loyalty Program, you agree to join the City Chic mailing list and to be bound by these terms and conditions and any variations to them.

1.2 You accept that by becoming a member of the City Chic mailing list and rewards program, you will receive periodic notification via email, text messaging and or conventional post outlining news, offers and other information relevant to our products and services or third party products and services. You understand that it is your right to unsubscribe at any time by forwarding a request via the website “unsubscribe” or via email, stating "unsubscribe" in the subject box. You understand that all requests for deletion will be processed within 14 days from the date of request.

1.3 You understand that City Chic’s Website Use Terms and Conditions also apply to my use of the City Chic website and form part of the legal terms on which I use the website and participate in the City Chic Membership and Rewards Program.

1.4 City Chic reserves the right to change these conditions at any time without notice and in its absolute discretion.

2. Membership

 2.1 Membership is available only to persons 18 years or over who live in Australia or New Zealand.

2.2 You agree to hold one membership only; and not apply for multiple memberships, whether by using multiple postal addresses, email addresses or otherwise.

2.3 You agree that to become a member you must provide a valid and unique email address and phone number and keep your contact details up to date. You are responsible for all use of your membership number and/or password. You agree to keep your membership number and password secret.

2.4 City Chic may accept or refuse application for membership for any reason, in its absolute discretion.

2.5 Upon becoming a City Chic Nation Loyalty Member in-store you may be issued with a City Chic Member Card, which can be used as proof of membership to the City Chic Nation Loyalty Program. This VIP Card is not transferable and remains the property of City Chic. It is your responsibility to keep this card safe and tell City Chic immediately if it is stolen or lost.

2.6 After joining online your email address can be used as proof of membership to the City Chic Nation Loyalty Program. You will not be issued with a VIP Card when joining online.

2.7 You are responsible for all use of your membership and associated benefits. City Chic Nation Loyalty Program benefits are not transferable.

2.8 To be eligible for CC nation membership and receive relevant communication, you may not share an email address or mobile telephone number. An email and mobile telephone number may only be associated with 1 (one) CC Nation membership account.

2.9 CC membership cards can be used in One Woman stores to accumulate reward points.

3. Nation Credits

3.1 Members can earn Nation Credits by presenting your Member Card, Member Card number or email address in-store or online at the time of purchase.

3.2 The current Nation Credit rate is 1 Nation Credit for every dollar spent at City Chic (excluding GST, other taxes and any packaging and delivery charges) in a single transaction at City Chic. City Chic may change this rate at any time by notice on its website or by other communication means. Nation Credits are rounded to the nearest dollar. Gift Card purchases, other taxes and any packaging and delivery charges do not qualify towards Nation Credits. Nation Credits earned on lay-by purchases will be applied in full on final payment of your lay-by.

3.3 Nation Credits are linked to tiers:

Bold = 0-299 Nation Credits

Sexy= 300-1299 Nation Credits

Glam = 1300+ Nation Credits

3.4 Tiers are calculated and based on your previous 12 months spend. Any transactions made during this time where your member card was not scanned will not be included in your tier allocation.

3.5 Tiers are reviewed annually on the 1st October. At the time of Annual review a member must have been in a tier for 12 months. If not your tier rewards will roll over to the next annual review period.

3.6 On the annual review of a tier on 1st October a member must have spent the minimum amount of the allocated tier to maintain the rewards of this tier. If this has not been achieved they will drop down to the tier in which they have met the minimum spend requirements.

3.7 Members may progress through tiers in a 12 month period with increased spend. However, the returning of items may result in a regression of tiers.

3.8 If you cannot provide proof of City Chic Nation Loyalty Program membership at the time of the transaction, City Chic is not obliged to issue Nation Credits on that purchase. Nation Credits will not be applied to orders already placed or to any transaction where a valid membership is not provided, this includes online transactions where guest checkout is used.

3.9 Nation Credits are earned on full price and sale transactions.

3.10 If you return any goods for a refund or your order is canceled or not fulfilled for any reason; the Nation Credits you have earned for that order will be reversed.

3.11 Nation Credits have no cash value and are not redeemable for cash.

3.12 City Chic will keep a record of the Nation Credits that you earn. City Chic reserves the right to correct your Nation Credit balance without notice if there are any errors in the award or redemption of credits.

3.13 Members will receive a monthly email of their Nation Credit balance. During a 30 day period before a balance is emailed to customers, there may be a delay in the allocation of Nation Credits earned from in-store and online purchases.

3.14 In-store and online Nation Credit balances and tiers will not be updated instantly. This will occur on the 1st of each month.

3.15 Rewards vary between tiers and at the discretion of City Chic.

3.16 The conditions of each reward will be specified at the time of execution.

3.17 Free Shipping for members of the GLAM tier will automatically be applied to online purchases at the time of checkout with an existing online member account, new member accounts will not be eligible to redeem until the following month.

3.18 Redemption for the bra offer specified per tier will be automatically applied to online purchases at the time of checkout when valid with an existing online member account, new member accounts will not be eligible to redeem until the following month.

4. Vouchers

4.1 Vouchers will be issued by City Chic via email, to the most recent email address on file.

4.2 By applying for or using a Voucher you consent to these Voucher terms and any other Voucher terms (Specific Voucher Terms) printed on the voucher or listed on the website or email where the voucher was issued. These terms apply to physical vouchers and to any electronic discount code that may be issued.

4.3 Voucher values are as specified on the physical voucher.

4.4 Birthday vouchers will be issued if we have a birthday on file, otherwise, anniversary vouchers will be issued. You will not receive both.

4.10 Vouchers must be surrendered on redemption, and must not be reproduced or copied in any way. Vouchers are not valid if reproduced or copied.

4.11 Without limitation, Vouchers issued on email are redeemable in-store or online. For online redemption the online code must be entered at checkout with an existing online member account, new member accounts will not be eligible to redeem until the following month. 4.12 City Chic reserves the right to choose how and when Vouchers are issued.

4.13 Vouchers are redeemable once only and are not transferable.

4.14 Vouchers will not be replaced if stolen, lost or not received.

4.15 Your Voucher must be redeemed in full in a single transaction during its redemption period. The voucher must be used on a purchase greater than the voucher amount. Neither cash nor credit will be issued for the balance of a voucher if not redeemed in full. Failure to redeem a voucher before the expiry date provided will result in the forfeit of your Voucher.

4.16 Where multiple items are purchased in a single transaction, the value of the redeemed voucher is allocated to each item in the transaction based on the proportion of the items value to the total value of all purchased items, excluding shipping, taxes and other charges.

4.17 If a Voucher is used and your entire order is cancelled or rejected, or you RETURN all or only some of the items in your order; we will refund the actual amount paid by you, subject to our applicable trading terms; and issue a credit note for the voucher discount applied to these returned item/s.

4.18 If a Voucher is used and your entire order or only part of your order is EXCHANGED for new items of equal or greater value, you will not forfeit the Voucher value applied to your original transaction.

4.19 Seasonal Wardrobe giveaways are specific to each tier. Entries open 1st December, 1st March, and 1st June. Members will be notified via Facebook and email of the winners. This will be subject to its own set of conditions.

5. Termination

5.1 Members may unsubscribe at any time with written notice by; (a) Going to the “Contact Us” page on the City Chic website and filling out the Enquiry Form with a request to unsubscribe; or (b) giving notice by post to Customer Service, City Chic Collective Ltd. 151-163 Wyndham St, Alexandria NSW 2015.

5.2 On termination of your membership to the City Chic loyalty Program, any unused Nation Credits Vouchers will be automatically forfeited.

5.3 City Chic may vary or terminate its City Chic Nation loyalty Program at any time, without notice in its absolute discretion. City Chic is not liable for any loss arising from termination or variation, including loss of Nation Credits or reduction in the value Nation Credits. Variations may include but are not limited to changing the ratio of Nation Credits earned to the amount spent, changing the ratio of Vouchers issued on Nation Credits earned; changing the expiry period of Nation Credits or Vouchers. This includes but is not limited to the discontinue, cancel or refusal to issue or honor any Voucher.

6. Privacy Policy

6.1 The City Chic Privacy Policy forms a part of these terms and conditions.

6.2 You understand that all personal information you provide including joining as a member, competition entries, makeover entries or requests for expert advice will reside in a centralised database at City Chic head Office in Alexandria, Sydney, Australia. All your personal information with be dealt with in accordance with the City Chic Privacy Policy.

7. City Chic

7.1 City Chic is a registered brand owned by City Chic Collective Ltd ABN 43 057 569 169.

7.2 City Chic accepts no responsibility for stolen, lost, damaged or misdirected VIP Cards, Rewards Vouchers or other member benefits.

7.3 To the extent legally permitted, City Chic excludes all conditions, warranties, guarantees and similar, whether express or implied, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the loyalty Program (Warranties), other than those implied by statute which may not be legally excluded. Any liability City Chic may have to you under Warranties implied by statute which cannot be excluded is limited, where expressly permitted by statute, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods, at City Chic’s option.

7.4 To the extent legally permitted, in no event will City Chic be liable to anyone for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever, including, without limitation, any lost profits or savings, damage to or loss of property or personal injury (including death), even if City Chic is expressly advised of the possibility of such damages. This exclusion and waiver of liability applies to all causes of action, whether based on contract, warranty, tort (including negligence) or any other legal theories. To the extent that the above exclusion of liability is unenforceable, invalid or ineffective for any reason, it will be severed from these Terms and City Chic’s maximum aggregate liability for all losses, damages and other amounts referred to in the above exclusion of liability under any cause of action referred to in the above exclusion of liability is limited to AUD$5.00

7.5 These Terms and Conditions apply to the City Chic Nation loyalty Program in general. Any additional competitions, special offers or other vouchers are subject to their own set of conditions, which will apply to you, if you choose to participate in the additional activity.

7.6 New South Wales law applies to these Terms.

City Chic allows user-generated content on our Facebook page including video, photos, wall posts and comments, at its discretion from time to time. However, City Chic is not responsible for the content submitted and does not endorse the opinions expressed by the users of this page.

3. How to Enter

comment section of competition post. This is a game of skill and entries will be judged based on their creativity and
originality.

Entrants must follow all instructions within the caption on the competition post on Instagram to be a valid entry.
The Daily Promotion will be run daily as set out in the following table. Daily Promotion entries are valid for the day of entry
only. Entries received after 3.59pm for the previous days Daily Promotion will not be accepted. Entrants may submit multiple
entries on multiple days.

One winner will be chosen for each Daily Promotion to be offered the prize in the first instance (Winner).

6. Notification of Winners and Acceptance of Prizes

Instagram handles will also be published on the Promoters website https://www.citychic.com.au/.
The Promoter will contact the Winners through Instagram direct message to arrange prize delivery. Prizes cannot be
transferred, exchanged or redeemed for cash. If a Winner does not accept the prize as offered in the time stipulated in the
notification of the win, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

7. Other Conditions
All entries become the property of the Promoter and, in submitting an entry, entrants agree to grant an irrevocable licence to
the Promoter to use all intellectual property associated with the entry in any way the Promoter chooses including amending
changing or adapting the intellectual property. The entrant will have no recourse to the Promoter for use of the intellectual
property in the entry.

All entries submitted will be entered into a database and the Promoter may use the entrant’s names, addresses and
telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and
without any fee being paid unless otherwise advised by the entrant. By submitting an entry, entrants confirm that they allow

Prices

Payment

The full payment for your order (including the product price and applicable delivery charges) is deducted from your credit card on completion of your order. Delivery will commence once payment has been processed/validated. We accept payment by Visa, MasterCard & Amex. Credit card details are processed using at least SSL 128 bit encryption and are not stored by us.

Large transactions may involve additional screening and we will require confirmation on key details before we proceed to fill the order. In this event, we will contact you. In some cases this may delay your order by a short period.

Availability

All goods are offered for sale subject to available stock. If an item is out of stock, we will issue a credit to your credit card account in the amount charged. If you order goods and some are not in stock, you agree that we may fill that part of your order for which stock is available.

Deliverability/Shipping

We ship within Australia and New Zealand only. We charge a fixed cost of $10 for deliveries within Australia (as varied from time to time and subject to a surcharge for large orders). For other destinations, shipping cost is determined by destination, weight and shipping method. To find out the shipping charges that apply to you, simply add the items to your shopping cart and proceed accordingly to the checkout where the full cost will be calculated and displayed before you make any payment. It is your obligation to enter the correct delivery address details at the time of ordering. We are unable to deliver to a P.O. Box.

We use all reasonable efforts to dispatch orders within 5 business days of the purchase date. Most orders should arrive within 5 to 10 business days after dispatch depending on the destination. It is your responsibility to inform us promptly if an order does not arrive either by emailing [email protected] or calling 1300 736 502 (within Australia). Once we learn an order has not arrived within a reasonable period we will lodge an enquiry with the courier and advise you of any issues that are discovered.

We are not liable for any loss or damage resulting from late delivery or non-delivery and late delivery does not entitle you to cancel your order. You have the option to have your item delivered with or without a signature of receipt. If you choose to have the item delivered without a signature of receipt you are responsible for any loss or damage after delivery.

If you choose to sign for your item you will generally need to be available between 7.00am and 5:00pm to receive the delivery. You have the option to choose a different delivery address than your billing address. For example you may want to use your work address for delivery if your employer’s workplace policies allow this. If you do not answer when the courier tries to deliver your order, the courier will generally leave a card. You must then contact the courier directly to arrange re-delivery. Without limitation, we are not liable for any loss or damage as a result of you failing to contact our courier within the time specified in any “article awaiting collection” notice left by the courier at the time of delivery.

Free Shipping Promotion

From time to time, we may offer free shipping promotions or similar. During the stated period of the promotion, the express terms of any specific promotion override these Terms other than the Special offers and Error sections. You must pay any return freight costs on change of mind purchases; however we will cover redelivery costs for exchanges for the first exchange. Faulty items will be replaced with the same item originally purchased where still available. For faulty items that cannot be replaced, a full refund will be offered; we will pay all freight charges on faulty items.

Damage

If you receive any goods in a damaged condition, we may issue you a credit in the amount paid for the goods or send replacement goods at our discretion if you notify us within 7 days of the delivery date. We may ask you to provide proof of the damage, as a condition of refund or replacement.

Risk

Risk of damage, loss or deterioration to goods passes to you on delivery in accordance with these Terms.

Title

Goods ordered by you remain our property until you pay for them in full.

Product Warranties

To the extent legally permitted, we exclude all conditions, warranties, guarantees and similar, whether express or implied, as to the condition, suitability, quality, fitness or safety of any goods or services supplied by us (Warranties), other than those implied by statute which may not be legally excluded. Any liability we may have to you under Warranties implied by statute which cannot be excluded is limited, where expressly permitted by statute, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods, at our option.

Returns

In addition to your statutory rights, if you change your mind we will happily exchange or refund your item/s providing the following conditions have been met:

1. The items are returned within 30 days of the purchase date and the original sales receipt is present.

2. Items must be in original condition as purchased, with all labels/tickets attached. Garment must not have been worn.

If you return items to us that do not comply with the above requirements, we will return them to you at your cost.

PACKING PROBLEMS Please check your items against your receipt. If there are any discrepancies please email [[email protected]] or call our Customer Service line on 1800 222 442 as soon as possible and within 30 days of purchase date.

You can exchange or return your online order to either the online store or a physical City Chic store with the original receipt you receive in your parcel subject to the terms of this section. Goods bought at a physical store must be returned to a physical store and cannot be returned to our online store. Orders purchased through our Official Partners cannot be exchanged or refunded in-store. For more information on how to return your Partner order, please refer to the returns policy outlined at the original place of purchase. We do not offer refund or exchange for change of mind purchases on swimwear, underwear, cosmetics or pierced earrings.

To obtain a refund via the City Chic online store, please download the refund form and post the order back to us with the form. Promptly after we receive your return package your refund/exchange will be processed and new item sent back out to you (where available) or we will credit your credit card, excluding delivery charges (unless goods are faulty or not as ordered). You will be charged an additional fee for redelivery. Do not re-use our courier bag.

Limitation of Liability

To the extent legally permitted, in no event will we be liable to any party for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever related to or arising from the supply of goods or services via this website or the use of such goods or services by any person, including, without limitation, any lost profits or savings, damage to or loss of property or personal injury (including death), even if we are expressly advised of the possibility of such damages. This exclusion and waiver of liability applies to all causes of action, whether based on contract, warranty, tort (including negligence) or any other legal theories. To the extent that the above exclusion of liability is unenforceable, invalid or ineffective for any reason, it will be severed from these Terms and our maximum aggregate liability for all losses, damages and other amounts referred to in the above exclusion of liability under any cause of action referred to in the above exclusion of liability is limited to AUD$5.00.

Indemnity

You agree to indemnify, defend, and hold us, our officers, directors, employees, agents, contractors, licensors and suppliers harmless from and against all losses, expenses, claims, proceedings, damages and costs (including actual, special, direct, indirect, incidental, exemplary or consequential) of every kind and nature made by any other party due to or arising out of any violation of these Terms, any terms and policies it incorporates by reference, the rights of another party, any applicable law, statute, ordinance or regulation or due to or arising out of any activity related to goods and services supplied by us.

We will endeavour to notify you of any delay and its expected duration. If we are prevented from performing our obligations for longer than a reasonable time, we may elect to cancel your order and issue you a credit in the amount paid for the order without further liability to you.

Entire Agreement

These Terms (including any terms or policies incorporated by reference) set out the entire agreement between you and us concerning its subject matter and supersedes all prior communications.

Alterations

We may alter these Terms from time to time by posting the altered version on our website. You should visit the website regularly to keep up to date with any alterations. In the case of an alteration, the altered Terms only apply to goods ordered via the website after the alteration takes effect.

Applicable Law

These Terms are governed by the law of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and its appellate courts. The United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention 1980) does not apply.

Errors

From time to time there may be errors on our website such as wrong pricing, wrong descriptions and offers for products that are not available or are no longer available. Despite anything else in these Terms, to the extent legally permitted, we may decline or cancel any orders that are affected by the error, even if the order has been confirmed and a credit card charged. If your credit card is charged for the purchase and we cancel the order, we will notify you and credit your credit card or paypal account for the amount charged.
